It is no secret that large corporations sometimes abuse their trademark rights and unreasonably seek to enforce such rights against small businesses or individuals despite the lack of any reasonable basis for believing a likelihood of confusion exists. In this regard, last March the President tasked the Department of Congress with undertaking a study regarding the extent to which small businesses may be harmed by abusive trademark tactics.
