5. Retainer and Fee Agreement

(hereinafter “Client”) retains Owens Tarabichi LLP to provide trademark watch services. The fee for this service is as identified in Section 3 (hereinafter the “Fee”). Client agrees that the Fee is considered earned on receipt and will be placed into Owens Tarabichi’s business account, rather than a client trust account. This service includes identifying third party marks according to the particular watch service requested that may be confusingly similar to the Client’s specified trademark for a period of one year from the date of submission of this Order. Client understands and acknowledges that no watch can guarantee that all pertinent references will be identified. Client understands and acknowledges that the ordered watch does not include any other legal work, such as an evaluation of whether any identified marks actually infringe the Client’s mark.

Owens Tarabichi LLP will notify the Client by email of any marks so identified at the email address provided above. It is Client’s responsibility to provide Owens Tarabichi LLP with any changes to the email address, and Owens Tarabichi LLP will not be responsible for identifying a forwarding address or forwarding any correspondence that cannot be delivered to the most recent email address provided by the Client.
